Nizam al-Waqf waAhkamuh al-Shar'iyah wa al-Qanuniyah : The System of Endowment and It's Legitimate and Juristic Status. This book is an encyclopedic work involving all endowment; legitimate, administrative, judicial, and applied rulings. It also states endowment effectiveness from the human, cultural, social and hygienic respects.

The work is divided into five chapters initiated by an introduction about the concept of the contract in the Islamic legislation as a basis of the endowment contract and the social role of the endowment institution as regards the cohesion of the Islamic Civilisation.


In Chapter One, the author expatiates the definition of endowment, whilst in Chapter Two, he indicates the conditions that must be available. In Chapter Three, he deals with guardianship, the due of endowment, the condition of the endower in addition to the matters relating to the endowment caretaker and guardian. Then he dedicates the Fourth and Fifth Chapters to endowing real estate and the conditions relating to their rent, replacement as well as the rights of emancipation therein. Finally he concludes the research, in Chapter Six.

From specialisation viewpoint, the book is deemed comprehensive in respect of the legal status of endowment in the Four Islamic Juristic Schools, as well as the zahirite school. This book is considered a reliable reference in the system of endowment from both legitimate and applied sides thereof.
