Al-Kalam 'ala Hinthi al-Nasi - this important work is essentially all about ijtihad (deriving or deducing an Islamic opinion based upon the laws of shari'ah). It analyses the obligation of one who forgets after taking an oath on a specific matter.


This publication also contains two other texts on ijtihad by the author Imam al-Subki, may Allah be pleased with him, namely Risalat fi Hatmiyat la Ijtihad Ma' al-Nass which looks into the issue of whether someone can excercise ijtihad along side the Nass (Qur'an or Hadith). With the third work being a fatwa for two questions regarding following a teacher in what he teaches the student.





About the Author :

Imam Taqi al-Din al-Subki, 'alayhi ar-Rahman w'al-Ridwan, the author, belongs to a large family of al-Subkis, whose members during the seventh and eighth century A.H. made themselves renowned, not only for their learning, high positions as qadis, jurisconsultants, professors, preachers, and writers, but also for their high personal qualities. As the family name al-Subki, shows the family of these times came from one of the two villages Subk in lower Egypt, namely the Subk in the province of Sharkiyya.


The family, however, carried its pedigree back to the time of the Prophet, may Allah bless him and grant him peace, and claimed to be descendants of the tribe of Khazraj, or one of the two dominating tribes of the old city of Yathrib, the later Madinah, who became the followers, supporters, and champions of [the Prophet] Muhammad, may Allah bless him and grant him peace. Hence the members of the Subki family call themselves al-Khazraji.


The pedigree of Shaykh Taqi al-Din, may Allah be pleased with him, as constructed from native biographers, is thus carried back through some sixteen generations to the time of the Prophet, may Allah bless him and grant him peace.
